By accessing or using SendBloc ("the App," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
SendBloc is a decentralized, wallet-native encrypted messaging application. These Terms govern your use of the SendBloc application, including all features, tools, and services provided through the platform.
SendBloc provides:
3.1 No Traditional Accounts: SendBloc does not require email addresses, phone numbers, or passwords. Your blockchain wallet address serves as your identity.
3.2 Wallet Responsibility: You are solely responsible for maintaining the security of your wallet, private keys, and seed phrases. SendBloc cannot recover lost wallets or private keys.
3.3 Authentication: Access to SendBloc is authenticated through wallet signatures. You are responsible for all activity conducted through your connected wallet.
You agree NOT to use SendBloc to:
5.1 Pro Pass: SendBloc offers a Pro Pass NFT that unlocks premium features including increased file sharing limits, priority message routing, custom themes, and advanced group management.
5.2 NFT Ownership: The Pro Pass is a blockchain-based NFT. Ownership is determined by on-chain records. SendBloc is not responsible for NFT transfers, sales, or losses on secondary markets.
5.3 Feature Availability: Premium features are subject to change. We reserve the right to modify, add, or remove premium features with reasonable notice to Pro Pass holders.
6.1 SendBloc IP: The SendBloc name, logo, brand elements, and proprietary technology are owned by SendBloc. You may not use our intellectual property without written permission.
6.2 User Content: You retain ownership of all messages and content you transmit through SendBloc. Due to end-to-end encryption, we cannot access your content.
6.3 Open Source: Portions of SendBloc's protocol may be open source and governed by their respective licenses.
7.1 AS-IS Service: SendBloc is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.
7.2 No Guarantee of Availability: We do not guarantee uninterrupted, secure, or error-free operation of the service. As a decentralized protocol, network conditions may affect performance.
7.3 Blockchain Risks: You acknowledge the inherent risks of blockchain technology, including but not limited to: network congestion, smart contract vulnerabilities, regulatory changes, and wallet security risks.
To the maximum extent permitted by law, SendBloc and its team, contributors, and affiliates shall not be liable for:
You agree to indemnify and hold harmless SendBloc, its developers, contributors, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
10.1 User Termination: You may stop using SendBloc at any time by disconnecting your wallet.
10.2 Service Termination: We reserve the right to restrict or terminate access to the App for users who violate these Terms or pose a threat to the network's integrity.
10.3 Effect of Termination: Upon termination, your right to use the App ceases. Given the decentralized nature of the protocol, some data may persist on the network.
11.1 Governing Law: These Terms are governed by applicable law in the jurisdiction where SendBloc operates.
11.2 Dispute Resolution: Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration.
11.3 Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or our official channels. Continued use of SendBloc after changes constitutes acceptance of the updated Terms.
